1. Acceptance of Terms

By accessing or using our Dating Simulation App ("Aiverse"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to all of these terms, do not use the App. These terms constitute a legally binding agreement between you and ImaginationAI.

2. Eligibility

Aiverse is intended for users who are at least 18 years of age. By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement. If you are under 18, you are strictly prohibited from using the App.

3. Description of the App

Aiverse is an AI-powered platform utilizing Large Language Models (LLMs) to provide an immersive experience of interacting with fictional characters. The App features a "traits system" allowing users to generate or customize fictional entities for entertainment purposes.

4. Account Registration & Security

To access certain features, you may be required to register for an account. You agree to provide accurate information and maintain the security of your credentials. You are solely responsible for all activities that occur under your account.

5. User Conduct & Prohibited Content

You agree not to use Aiverse to create, share, or interact with content that:

• Depicts or encourages non-consensual sexual content or illegal acts.
• Promotes hate speech, discrimination, or violence against individuals or groups.
• Harasses, threatens, or intentionally demeans other users or real-world individuals.
• Infringes upon the intellectual property or privacy rights of third parties.
• Attempts to "jailbreak" or manipulate the AI to generate prohibited content.

6. User-Generated Content (UGC)

You retain ownership of the character descriptions and "traits" you manually input. However:

• License: You grant ImaginationAI a non-exclusive, royalty-free, worldwide license to use, host, and display your UGC solely to provide the Service.
• Responsibility: You are solely responsible for the legality and appropriateness of the characters you create.
• Moderation: We reserve the right to remove any UGC that violates these terms or is deemed harmful by our moderation systems.

7. Intellectual Property & AI Outputs

The App interface, traits system, and branding are the property of ImaginationAI. Regarding AI-generated outputs (chat responses):

• Outputs are generated by third-party AI technology (e.g., OpenAI).
• ImaginationAI does not claim ownership of AI-generated responses but grants you a limited right to use them for personal, non-commercial entertainment.
• Commercial use of AI outputs requires explicit written consent from ImaginationAI and may be subject to third-party AI provider terms.

9. Subscriptions and Payments

Premium features are available via subscription. All transactions are handled by the Apple App Store or Google Play Store. Subscriptions auto-renew unless canceled at least 24 hours prior to the end of the billing period. Refunds are subject to the policies of the respective App Store provider.

10. Termination

We reserve the right to terminate or suspend your access to Aiverse at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Limitation of Liability

Maximum Extent Permitted by Law:

AIVERSE IS PROVIDED "AS IS." IMAGINATIONAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP OR ANY AI-GENERATED CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Governing Law

These terms are governed by the laws of the jurisdiction in which ImaginationAI is registered. Any disputes shall be resolved through binding arbitration in said jurisdiction.
